
A Business Associate Agreement or BAA is a written contract between two parties that creates a bond of liability and is typically needed for HIPAA compliance purposes. If you are a HIPAA Covered Entity or Business Associate dealing with ePHI, PHI, or any other personally identifiable information then by law, a BAA is required.
However, there are exceptions… if you are a healthcare provider, healthcare clearinghouse, or manage health plans and DO NOT transmit personally identifiable information for transactions, The United States Department of Health and Human Services (HHS) states that you do not have to comply with HIPAA standards and requirements.
